Introduction

By accessing or using Lixsa, you agree to comply with these Terms.
1. Service Description
Lixsa is a SaaS platform that provides automated customer support solutions using artificial intelligence. Our services include, but are not limited to, conversation management, customer data analysis, and personalized recommendations.
2. Registration and User Account
To access certain features of the service, you must register an account by providing true and complete information as requested during the registration process. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer.
3. Data Collection and Use
3.1 Collected Data
At Walkon Livos SL, we value the trust our customers and their customers place in us by using Lixsa for their operations. Data collection is a fundamental aspect of our services, allowing us to offer highly personalized and effective artificial intelligence solutions. The types of data we collect include, but are not limited to:
- Personal Information: Names, surnames, email addresses, phone numbers, and physical addresses.
- User-Generated Documents and Content: Any document or information uploaded to Lixsa for training or support purposes, including texts, images, and communications.
- Technical Data: IP addresses, device identifiers, browser types and settings, operating system, network information, and platform usage data.
This information is essential for training Lixsa, improving response accuracy, and personalizing the user experience. The collection, use, and protection of this data are strictly regulated by our Privacy Policy, which adheres to applicable data protection laws.
3.2 Data Security
Aware of the importance of maintaining data security and privacy, we have implemented a robust framework of technical and organizational measures to protect the collected data. These measures include:

4. Intellectual Property
The protection and respect for intellectual property are fundamental pillars in the operation and success of Lixsa, provided by Walkon Livos SL. Below, we detail the scope and implications of intellectual property related to Lixsa and user-generated content.
4.1 Lixsa Content
The content generated by Lixsa, encompassing, but not limited to, artificial intelligence models, algorithms, software, user interfaces, graphics, design, data compilations, trademarks, logos, and any other visual or textual material provided through Lixsa, is the exclusive property of Walkon Livos SL or its licensors. This content is protected by intellectual property laws, including copyright and trademark laws, both nationally and internationally.
The use of Lixsa by the user does not imply the transfer of any intellectual property rights except for the limited and revocable access and use of the service in accordance with these Terms. Any unauthorized use of Lixsa content, including reproduction, modification, distribution, transmission, republication, or display, without the prior written consent of Walkon Livos SL, is strictly prohibited.
4.2 User Content
By using Lixsa, users may upload, transmit, or enter content, including, but not limited to, texts, images, information, and any other type of data, for the training of artificial intelligence models or for the personalization of the service (“User Content”). In doing so, the user grants Walkon Livos SL a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works, display, and perform the User Content in connection with the provision of the Lixsa service and Walkon Livos SL’s business, including without limitation for promoting and redistributing part or all of the service.
This license is intended to allow Walkon Livos SL to improve and personalize the Lixsa service, develop new services and functionalities, and conduct research and analysis. The user represents and warrants that they have all the necessary rights to grant this license for the User Content provided and that the use of such content by Walkon Livos SL does not infringe, misappropriate, or violate the rights of third parties, including privacy, publicity, intellectual property, or other proprietary rights.
4.3 Responsibility for User Content
Walkon Livos SL assumes no responsibility for User Content provided by users. Users are solely responsible for their User Content and the consequences of sharing or publishing it through Lixsa. Walkon Livos SL reserves the right, but has no obligation, to monitor, edit, or remove User Content that it considers, in its sole discretion, to be in violation of these Terms, applicable laws, or third-party rights.
5. Payments, Subscriptions, and Conversation Usage
5.1 Choice of Subscription Plans
Lixsa offers a variety of subscription plans designed to meet the different needs of our customers. Each plan provides access to our service and a specific number of conversations that can be used during the subscription period. Details, including pricing and specific features of each plan, are detailed in our price list accessible on our website and/or through the Lixsa user interface.
5.2 Definition of Conversation
For the purposes of these Terms and Conditions, a “Conversation” is defined as an exchange of messages between an end user and Lixsa, or a human agent belonging to Lixsa’s client, within a 24-hour time window, limited to 1,200,000 words. If the word volume is exceeded before 24 hours, it will be counted as a new conversation.
5.3 Conversation Window
The conversation window is the 24-hour period during which message exchanges are counted as part of a single conversation. This window begins with the first message sent by the end user or Lixsa and concludes 24 hours later, at which point a new conversation may be initiated according to the above definition.
5.4 Overages and Auto-Purchase of Conversations
If a client exceeds the number of conversations included in their subscription plan within the current billing period, Lixsa will automatically allocate an additional volume of conversations, equivalent to 10% of the total included in their subscription plan. This process is known as “Auto-Purchase of Conversations.”
Example of Auto-Purchase of Conversations
If a client has a plan that includes 200 conversations and reaches this limit before the renewal of their plan, Lixsa will automatically allocate 20 additional conversations (i.e., 10% of 200) to the client’s account. The client will be responsible for the charges associated with these additional conversations, according to the rates specified in our price list.
5.5 Charges for Additional Conversations
Additional charges incurred by the auto-purchase of conversations will be applied to the client’s account at the price set for the client’s specific subscription plan, as detailed in our price list. These charges will be billed additionally and will require a valid payment method registered by the client.
5.6 Non-Payment
If Lixsa is unable to process the payment for the additional charges due to the lack of a valid payment method or insufficient funds, Lixsa reserves the right to temporarily suspend the service until payment is made. The reactivation of the service will be subject to the payment of all outstanding charges.
5.7 Changes to Subscription Plans
Clients may change their subscription plan at any time during the billing period, subject to the specific terms of plan change detailed in our price list and service policies.
6. Limitation of Liability
6.1 Service and Availability
At Walkon Livos SL, committed to the excellence of our Lixsa service, we continuously strive to ensure a 99% availability to our customers. We understand that uninterrupted access to our solutions is crucial for our users’ operations. However, we recognize that unforeseen situations may arise that affect this availability. These situations include, but are not limited to, scheduled maintenance, system updates, and unexpected technical failures that may result in temporary service interruptions.
In the case of maintenance or updates, we commit to notifying our customers in advance, providing details about the nature of the work to be performed and the estimated time of interruption. Our goal is to minimize any inconvenience this may cause to our users, scheduling such activities during low activity periods whenever possible.
6.2 Accuracy of Responses
Lixsa, being an advanced solution that uses artificial intelligence to provide answers and solutions to users, is fed by the data provided by our customers. We commit to ensuring that at least 70% of the responses are accurate, based on the available information and the parameters set by the client.
However, the performance and accuracy of Lixsa largely depend on the quality and completeness of the data supplied by the client. In this regard, Walkon Livos SL will not be liable for:
- Incorrect, incomplete, or erroneous information provided by the client resulting in inaccurate responses.
- Decisions made or actions taken based on the responses provided by Lixsa.
- Any indirect, special, incidental, or consequential damage, including, among others, loss of revenue, loss of profits, loss of data, or any other economic loss that the client or third parties may suffer as a result of using or the inability to use Lixsa, even if Walkon Livos SL has been advised of the possibility of such damages.
Client Responsibilities
It is the client’s responsibility to ensure that the information provided to Lixsa is complete, accurate, and up-to-date. The client must also review the responses generated by Lixsa to verify their accuracy before taking any action based on them. In case of detecting inconsistencies or errors, the client must immediately inform Walkon Livos SL to allow for the necessary corrections.
Updates and Improvements
Walkon Livos SL is committed to continuously improving the accuracy and functionality of Lixsa. This may include system updates, improvements to artificial intelligence algorithms, and expansions of the knowledge database. We reserve the right to implement such improvements without prior notification to the client, always seeking the benefit of the user experience and the quality of the service provided.
7. Dispute Resolution
All disputes arising under these Terms will be resolved first through mediation. If mediation does not result in a resolution, disputes will be submitted to the exclusive jurisdiction of the courts of Barcelona, Spain.
8. Modifications to the Terms
We reserve the right to modify these Terms at any time. Modifications will become effective immediately after their publication on our website or notification to the user.
